Do You Qualify for Bankruptcy?

One of the major public misconceptions about personal bankruptcy is that almost no one qualifies for debt discharge bankruptcy, which is called Chapter 7 bankruptcy. This is not true. To successfully file Chapter 7 bankruptcy, you must pass a means test. If your income is lower than the state’s median income, or if your debts are more than a certain proportion of your income, then you may qualify for Chapter 7 bankruptcy.

Even if you do not qualify for Chapter 7 bankruptcy, you may still file a Chapter 13 bankruptcy petition, which reorganizes your debt payments into amounts you can reasonably afford and discharges most debt that remains after a three- to five-year repayment period.
