Can I File More Than Once?

One of the more common misconceptions about bankruptcy is that a person is only able to file one time and then will never be allowed to file again. This is not true. While there are certain restrictions with regard to how frequently you are able to receive a discharge under the same chapter, there is no statutory limit as to the number of times you can file bankruptcy.

In general terms, you are able to receive a discharge under Chapter 7 once every eight years. You are able to receive a discharge under Chapter 13 once every two years, although most people don’t file under Chapter 13 this frequently since the typical Chapter 13 repayment plan lasts three to five years.

Depending on your situation, you could legally obtain a discharge of your unsecured debts under Chapter 7 and immediately follow it up with a Chapter 13 filing to address those debts not eligible for discharge under Chapter 7. This is sometimes referred to as a “Chapter 20″ bankruptcy.
